Information about JSC “EXIAR”

EXIAR was established as a specialised state institution to support exports through the provision of a range of export credit and investment insurance products. It is Russia’s national export credit agency (ECA), and was built from the ground up as a result of a push by the Russian government in late 2009 to step up the development and implementation of its export support programme. This project formed one of several anti-crisis measures drawn up at the time to spur national economic development.

Since the agency’s inception, a range of systemic initiatives have been drafted and implemented to help boost export activity both at the national level, and in specific areas and industries (innovation, aviation, agriculture, exports by SMEs, etc.). These include a road map entitled ‘Supporting access to foreign markets and supporting exports’, which aims to solve specific problems related to bottlenecks in export procedures, and was first implemented following the issue of Russian Government Decree No. 1228-r dated 29 June 2012. In 2014, ownership of Eximbank of Russia – which specialises in financing export transactions – was transferred to the agency. This was in response to a presidential directive to streamline financial support for exports by consolidating existing credit and insurance services under the EXIAR umbrella. In 2015, the Russian government acknowledged the desirability for a one-stop shop to be established as part of Vnesheconombank, offering financial and non-financial support for exports. Consequently, in April of that year, the Russian Export Center was officially registered as company, and relevant legislative amendments were introduced by Federal Law 185-FZ dated 29 June 2015 (‘On amendments to Federal Law “On the bank for development” and part two of article 970 of the Civil Code of the Russian Federation’). On 10 December 2015, the Russian export center became the sole shareholder of JSC "EXIAR".

The agency plays an active role in helping to further develop the state’s export support system. It also regularly interacts with key ministries and agencies on related matters, including with the Russian government, the Ministry of Economic Development, the Ministry of Finance, and the Ministry of Industry and Trade. At the same time, it continues to accumulate expertise and international experience in the highly specialised field of financial services, while also acting to meet the needs of exporters. The agency’s success in this area is in large part due to its accrued experience in export transactions and its understanding of the specific requirements of growing exports in Russia.

Agreement on the Protection and Promotion of Investments

NWPC: Russian Federation/Subject of the Russian Federation/Investor/MO

The amount of capital investments, if the party to the agreement is a subject of the Russian Federation:

  • at least 200 million rubles

The volume of investments, if the party to the agreement is the Russian Federation and the subject of the Russian Federation:

  • at least 750 million rubles: healthcare, education, culture, physical education and sports
  • at least 1.5 billion rubles: digital economy, environmental protection, agriculture, food processing, tourism
  • at least 4.5 billion rubles: manufacturing facilities, air terminals, public transport of urban and suburban communications, transport and logistics centers
  • at least 10 billion rubles: all projects regardless of the economic sphere

Reimbursement of actual costs incurred:

  • it may not exceed 50% on the objects of the supporting infrastructure (including the payment of interest on loans, coupon income on bond loans aimed at infrastructure facilities), on the payment of interest on loans, coupon income on bond loans in terms of real estate and the results of intellectual activity
  • it may not exceed 100% for related infrastructure facilities (including the payment of interest on loans, coupon income on bond loans aimed at infrastructure facilities), for the dismantling of military camp facilities

Conditions of conclusion of the NWPC:

  • compliance of the project and the organization with the spheres of economy established by the legislation
  • the decision on the budget was made no later than 180 calendar days from the date of receipt of the construction permit, and the application for the conclusion of the NWPC was submitted no later than 1 year from the date of the decision on the budget

Exceptions by fields of activity for NWPC:

  • gambling business
  • production of tobacco products, alcohol, liquid fuels, with the exception of fuels obtained from coal, as well as at refineries of petroleum raw materials according to the list approved by the Government of the Russian Federation
  • crude oil and natural gas production, except for investment projects to reduce natural gas
  • wholesale and retail trade
  • activities of financial organizations supervised by the Central Bank of the Russian Federation, except in cases of issuing securities to finance projects
  • construction (modernization, reconstruction) of administrative and business centers and shopping centers, as well as residential buildings

The validity period of the stabilization clause:

6 years with an investment of up to 10 billion rubles

10 years with an investment of 5 to 10 billion rubles

15 years with an investment of 10 to 15 billion rubles

20 years with an investment of at least 15 billion rubles

An agreement on the protection and promotion of investments may be concluded no later than 01.01.2030.

NIP selection Criteria

The volume of investments is at least 50 million rubles.

The existence of an agreement of intent on the implementation of the NIP, concluded by the supreme executive authority a subject of the Russian Federation and a potential investor, containing information on the planned volumes of investments, the number of jobs created necessary for the implementation of NIP infrastructure facilities, the amount of taxes paid to budgets of all levels of the budget system of the Russian Federation for the period of project implementation, as well as the investor's obligations to submit a report on the progress of NIP implementation to the subject of the Russian Federation.

Availability of a document containing a brief description of the NIP and its objectives, in accordance with the approved form (summary of the NPC).

Reimbursement of 100% of the investor's infrastructure costs.
